CANADA POST CORPORATION

AND

CANADIAN UNION OF POSTAL WORKERS

Regular Arbitration - Toronto, Ontario - August 14, 1995

Appearances:            For the Corporation - L. Waine

For the Union (Scarborough Local) - R. Irwin, A. Colacci, G. Smith

602-95-00146  C. Goodman

Ten-day suspension for alleged personal use of Priority Courier service without payment.

The evidence supports the employer's allegation . Apart from being a serious breach of procedure, the grievor’s action implies an intent to defraud the employer.  Union does not refute the evidence but submits that the disciplinary penalty was too harsh.  My finding is that the grievor was guilty of serious misconduct and that the disciplinary action, in the circumstances, was not excessive.

Grievance denied.
