            By virtue of the employer's shortcoming in its posting procedures the trade union was misled with respect to the nature of the vacancies and thereby was warranted in delaying its grievance until it appreciated the true nature of the bidding process.

            The employer's preliminary objection on the grounds of timeliness is therefore denied.

            The parties agreed to meet with a view to resolving the

merits of the dispute.
