AWARD

 

            Pursuant to Article 9.32(5) of the collective agreement, I conducted hearings at the City of Toronto, Ontario, on June 16 and 17, 1994, in order to hear and determine a series of grievances under the regular arbitration procedure.

 

            At the conclusion of the argument on each grievance, I delivered oral reasons, giving a brief resume as required by Article 9.32(5)(r) of the collective agreement.  I now hereby confirm my conclusions.

 

In the Matter of the Grievance of P. Thambiraiah - No. 602-92-02537

 

            The issues in this grievance relate as to the proper basic pay and acting pay for P. Thambirajah who was a mail service courier from March 1, 1993, to the present.  It is alleged that he was not paid his proper basic pay given his seniority date and did not receive the appropriate acting pay while acting as a full-time letter carrier.  This grievance is adjourned in order to give the Corporation an opportunity to prepare a full pay audit of the wages that Thambirajah was paid in the period in question.  The pay audit shall disclose the periods during which he performed in an acting capacity, as well as his basic and acting rate of pay that he was paid.  I direct that a copy of the pay audit is to be provided to the Union and to the grievor within 30 days of this date.

In the event the parties are still unable to agree as to Thambirajah's proper basic and acting pay following receipt of the pay audit, either party may write to me for the purposes of resolving any outstanding dispute.
