Pursuant to Article 9.32(5) of the collective agreement, I conducted hearings at the City of Toronto, Ontario, on June 16 and 17, 1994, in order to hear and determine a series of grievances under the regular arbitration procedure.
At the conclusion of the argument on each grievance, I delivered oral reasons, giving a brief resume as required by Article 9.32(5)(r) of the collective agreement. I now hereby confirm my conclusions.
In the Matter of the Grievance of W. Jenkins - No. 602-92-02400
This is a grievance by W. Jenkins alleging that the Corporation breached Article 20.06 of the collective agreement by failing to provide to him sick leave credits with respect to his absence between June 10 and 18, 1993, (inclusive) by reason of illness. The evidence indicates that the employee signed a statement as required by Article 20.06(b) of the collective agreement and that the illness was certified by a medical practitioner. For some reason which is unexplained, he was paid only for June 10, 11 and 18, 1993, but not for the remaining days of his certified absence by reason of illness.
The grievance is allowed and the Corporation is ordered to pay him forthwith from his sick leave credits the wages that he ought to have been paid for June 12, 14, 15, 16, 17 and 19, 1993.
