Pursuant to Article 9.32(5) of the collective agreement, I conducted hearings at the City of Toronto, Ontario, on August 19, 1993, in order to hear and determine a series of grievances under the regular arbitration procedure.
At the conclusion of the argument on each grievance, I delivered oral reasons, giving a brief resume as required by Article 9.32(5)(r) of the collective agreement. I now hereby confirm my conclusions.
1. In the Matter of the Grievance of the Scarborough Local - #602-92-01059 This is a grievance by Tom Tsolakis, a term letter carrier, alleging that the Corporation breached Article 34.04 of the Collective Agreement by failing to issue to him appropriate seasonal uniforms as prescribed. The evidence indicates that this grievance was originally heard on January 13, 1993 and that in fact a full uniform was ordered to be issued on January 6, 1993. For reasons which are not clear to me, he has only received parts of the required uniforms and certain items are still outstanding. As a result, the employee has had to go out and buy some clothing of his own and has incurred expenses in this respect. In my view, the appropriate order is to require the Corporation to supply Tsolakis within fifteen (15) days of this date appropriate seasonal uniforms as stipulated by Article 34.04(a) of the Collective Agreement and to compensate him for the monies that he has expended on his own. I shall remain seized of this matter in the event the parties are unable to agree as to the quantum of compensation.
