On January 6, 2014 Arbitrator Jolliffe released his decision in the application for an injunction by the Union in movement of between 124 and 77 Group 2 employees to the “Old” West C&D Post Office from the Scarborough Local. The Union was of the opinion this violated a memorandum of agreement signed October 11, 2011, concerning the movement of MSC work to the stations under Postal Transformation. This MOA was renewed under Appendix C of the new Collective Agreement.

The Union was successful in it’s application for a “Cease & Desist” order for 20 days. It is renewable every 20 days, until the outcome of future litigation on the issue’s. The Union met the test of a “prima facie” case, along with four other tests.

For current Group 2 employees of the Metro East C&D / Retail Post Office (aka: the Scarborough Local), you will not be moved to the West C&D / Retail Post Office. Only the East C&D Final Sort (WLPP) Annual Leave consultations have taken place since this recent award, other consultations are pending.  The employer has indicated they will start posting monthly bids this month for the Letter Carriers, MSC’s and Clerks. The Employer has not indicated how they will adjust the transfer lists that were merged. The Local is attempting to set up consultations at the National level in the near future on outstanding issues.

This is a huge victory for the Local and the Union, preserving a large number of positions until natural attrition takes place.

With mail not being delivered for two weeks in many cases, forced overtime on other routes after your own 10-12 hour day, and this winters conditions, imagine how much more mail would be delayed if CPC had gotten their way and moved 80 to 120 Relief to the West. Canada Post is not interested in delivering mail, Canada Post Management is interested in protecting / boosting their bonuses by reducing costs.
