SLC BIDDING FOR ASSIGNMENTS

RECENTLY THE LOCAL ARGUED A GRIEVANCE ALLEGING THE EMPLOYER WAS BREACHING RELIEF LETTER CARRIER SENIORITY RIGHTS BY NOT ALLOWING THEM TO BID TO COVER PART TIME ABSENCES DURING THEIR SELECTION OF ASSIGNMENTS PURSUANT TO ARTICLE 52.

THE EMPLOYER, NATURALLY, ARGUED THAT THEY COULD ONLY BID ON FULL TIME POSITIONS.

IN AN AWARD RELEASED JUNE 25, 2002, ARBITRATOR VON VEH SUSTAINED THE GRIEVANCE AND MADE THE FOLLOWING ORDER:

“Having regard to the findings and observations set out above, a Declaration is hereby issued that the Corporation’s practice, in the Scarborough local, of not permitting full time relief letter carriers to bid on part time absences, is in violation of Article 52 of the Collective Agreement.The Corporation is hereby ordered to forthwith stop such said practice in the Scarborough local, and permit full time relief letter carriers to bid on part time absences.”

EFFECTIVE IMMEDIATELY, ALL ABSENCES – BOTH FULL TIME AND PART TIME – SHOULD BE OPEN FOR BIDDING TO FULL TIME RELIEF LETTER CARRIERS.

HOWEVER, PLEASE NOTE THAT SHOULD A RELIEF CARRIER BID TO COVER A PART TIME ABSENCE, THE EMPLOYER HAS THE RIGHT TO ASSIGN ADDITIONAL WORK TO TOP UP TO AN 8 HOUR WORK DAY. THE ASSIGNING OF ADDITIONAL WORK IS STILL SUBJECT TO THE PROVISIONS OF THE COLLECTIVE AGREEMENT.
