Scarborough Local / Metro East Delivery Ops Monthly Consultation Held April 05 , 2004 At 280 Progress Ave

Previous Business
1) Monthly Bid Posting Union Feel it is much better, however there were some errors with respect to Scarb F. We requested and received an amendment. Feel that the local supervisors should review prior to posting, that way errors can be caught earlier. Mgmt will share with supervisors. Union had requested, but yet received a list of employees, I Ds walk number and position number. Mgmt SAP is not able to produce such a report. Will provide a position number and employee, and ID number report
2) Unionville Article 50 Walk 12 Mgmt The RMOs arrived to block the walk however as not all P.O.Cs the A-32 case new case strips need to be completed in order to conduct the article 50.
3) Pay Issues Union concern were employees who are not working the scheduled 80 work week and are having an overpayment deducted, the deduction of 10 % is based on the gross 80 hrs not the hours worked. Mgmt the system is set up to recover 10% of gross, which is the employees scheduled hrs. If the employee only works 60 hrs the 20 hrs show as LWOP against the gross of 80 hrs.. Union also concerned when the employer overpays and recoverys the full the amount without notifying the employee. Any overpayment can only be recovered as per 35.06. Our position is that the recovery applies to any and all overpayments made by the employer. Mgmt this clause was intended to apply to those employees who suffered an injury that was not, in review, work related and had been advanced money as per 20.11. It was not intended to be a loan service where employees receive money they are not entitled to based on an input error. Union we respectfully disagree.
4) Member in good standing Hiring/ promoted - Closed Mgmt this was discussed at the regional level with the Toronto on Mar 02, 04. D. Munn looking at a process 5) Overtime on Biweekly Cheques - Closed Mgmt no process in which to identify the period, employees should be aware that it is for the previous two week period. Issues that arise should be discussed with the supervisor/superintendent.
6) Posting of LTA in Group 1 ( 39.07) New language - Closed Mgmt this will take place as per C/A by installation Union we understand that our concern is that if an error is made in the application and we are not involved form the start the corporation is at risk of liabilities for employees affected. The Union is asking for either a bid format or some paper trail that can be shared at the time of the LTA coverage Mgmt Employee Admin. will look at a process and respond .
7) Loss of Benefits Retroactively - Closed Mgmt with respect to the issue of retroactivity for loss of benefits, be advised that this should not be an issue into the future. SAP sends a flag to the supervisor to action the TSOS status. This was the problem in the past where there was no checks and balances and employees where found to be overpaid by consider- able amounts , which in turn caused the benefits to be discontinued. 8) MLC Duties Union concern that employees are not trained prior to reporting with respect to the scanning of SLBs and the portable scanner for PCIs Mgmt will review. Union concerned that some of the start times for the Malvern MLCs have been changed without consultation ie rte 1 changed 07:00 to 06:30, as did rte 22. Mgmt will investigate and respond Union the concern is that any changes to the start time could result in other L.Cs missing drop departures. Also understand that employees who have submitted training requests under art 40 are being denied. In order to facilitate for vertime opportunities these employees are entitled to the training. Mgmt regular L.C duties, what training do you see being required. Union as stated above as well as VOP for those L.C wishing O.T. Mgmt will review the VOP lists.
9) Bar Charts Ajax Union have not received the Bar Charts. Mgmt these should be available by next week. It is our understanding J. Leblanc is vetting the data.
10) Bar Charts for the recently restructured Stns Union request the tombstone data page, from the program for the following stns : Malvern, West Hill, Scarb. D, F and Willowdale B. Also request the data for the 12 months period prior to the implementation date. ( trend pages) Looking for process to merge MSC data with the LC data for the prior twelve month period Mgmt have reviewed the package associated with the bar chart program and the restructure date and the change to the tombstone data is required and will be provided There is no requirement to merge the data, the new 075s will establish the minimum relief requirements. As for bar chart added relief .any positions required as a result of the new establishment will be determined at the review period in the Sept. Union feel that this is unique as you are not just adding positions but converting positions and that as such should be included in the past data to indicate the relief needs for those positions. Mgmt will follow up with national LR
11) Severance Payout Errors Union as raised at last meeting what is the process to resolve errors in respect to the payment notices. Feel that this will be issue with some part-time employees based on schedule and the established hours of routes. Mgmt There is a national group that is set up to respond to questions that arise with respect to the calculation of the severance amounts. By restricting complaints to this group it is felt that each employee will receive the best solution, as this group has access to all the records. They can be reached in one of 4 ways

Union what if the employee still disagrees Mgmt the employee should use the options open to them under the collective agreement.
12) Willowdale Depot 3 MSC duties Mgmt this is still being investigated
13) Pickering Monthly minutes Union - this is ongoing concern as we receive complaints on a regular basis that the minutes are not posted. Mgmt these are distributed and posted monthly, as you are aware these can be removed from the information books at any time by anyone, will repost last months in Pickering. Request that employees speak the superintendent/supervisor in instances where the minutes are found to have been removed.
New Business
1) Malvern Bar Charts Union received a disk with the wrong version of the program Mgmt - the bar charts are being redone
2) Article 13.25 Mgmt would like to propose that the Corporation post to all part-time ees in the Toronto East Collection and Delivery / Retail Post office opportunities for promotion to fulltime where routes are increased from part-time to full-time as a result of growth . This would meet the requirements of 13.25 to offer by seniority the position. Union how would this address ees on leave. Mgmt this would be no different from the process for walk bids, up to the individual to notify the Corporation to send any bids to them. Union will discuss and respond.
3) Process to allow MSCs that were assigned/ unassigned following the last bid to remain at Stns temporarily Union - as a result of the last bid a number of the stn MSCs were assigned to own or temporarily assigned to YDC tours. In reviewing the results it appears that the stns will have a number of uncovered tours on Apr 19, 04. How do you plan to cover these tours? You cannot use letter carriers . Mgmt suggest that we reclassify the vacant tours as MLCs. Union cannot agree to fast track the C structures,a s we have concerns over those already completed. We suggest that you allow the MSCs to remain at the stns and have YDC use art 17 to cover. Mgmt will advise Note - this item was discussed at the Parcel Model meeting held on April 08, 04. It was agreed that those assigned, either as tour holders or temporarily as unassigned, to YDC will remain in the Stns . There were 13 ees involved. It was further agreed that YDC will freeze these 13 vacancies and cover the rtes under art 17.04. As the stns are converted these employees will then be moved into the 13 positions. Union concerned that the RMOs are already calling some stns asking the superintendent to identify rtes to merge with the MSC tours. Feel that this does allow are observers to be part of the process as required.
4) Plan C Restructure Schedule Mgmt suggest this item be tabled to the parcel meeting scheduled for April 08, 04.
5) Plan A Restructure Schedule Jan 05 Jan 07 Union received a schedule and noticed Don Mills removed and Scarb Depot C and Depot 4 were added. Is it possible to get a schedule covering the duration of the contract, realizing that changes may be required. This would allow us to review and identify concerns with respect to what stns we see as needing priority on the list. Mgmt we recognize you r concerns with respect to the constant changes to the schedules that you have been provided however the schedule is being driven by several factors, Private vehicle usage meal on route and of course growth and overassessment. Union we would like to see a facility like Unionville on the schedule as a priority. Mgmt will discuss with Delivery Services with respect to creating a draft this may take some time however hope to have it within a months time. Would like to discuss the option for employees to be able to bid off or onto PV routes. Union our position is unchanged and feel it coincides with national position on the matter.
6) Monthly Bar Chart Review Union notwithstanding the yearly review of trends would like to start discussing the monthly charts and any concerns with respect to entries so that the yearly trends will be easier for both sides to discuss with respect to staffing requirements as the data will not be an issue. Mgmt agree will advise superintendents that this information will be required each month.
7) Easter weekend Operations The parties discussed the Corporations plans as to Easter Monday operations.

1) MSC tour value changes Mgmt provided the Union with a list of the tours and the changes to the routes. Will without prejudice or precedent agree to effective to restore the tours to the Nov 17, 03 values where required. In doing so it is understood that any routes affected will have as directed time equal to the difference of current value and the Nov. 17, 03 value.

1) Maple Post Office Union still have issue with the 1 day delivery requirement for admail in this office, will escalate to the Transition Committee.
2 ) Pay Problems Mgmt advised the Union that in some cases helpers may be required to wait as long as 45 days before being paid. All paper work must be submitted by the 15th of each month for payment that month. Union with respect to WBC and Malvern SS rtes, we know that these documents were submitted, yet still no adjustment to the compensation packages. Mgmt - will follow up with Delivery Planning as well will invite a representative to future meetings. Update The documents for the Malvern routes has been resubmitted to Delivery Planning. Union have been advised by several employees that the compensation received for March was considerably higher than for February. As you are aware there is some difficulty in obtaining statements. Wish to find out why. Mgmt will investigate.
3) Schedule A;s Union still have not received the copies of the schedule A s as indicated , this were expected in December. Mgmt will follow up with transition team and respond.
4) New Parcel Model Impact Mgmt - will discuss with R. Gualtieri asked for the information will provide upon receipt. Union our preliminary observations indicate that some routes may receive as many as 45 items from the UEC business. . This will fall under Art 12 and could result in the application of Art 32 with respect to vehicle type required. Also request that advance notice regarding the implementation be provided in order that appropriate vehicle type is available on start up. Mgmt will follow up with parcel Model team and Transition Committee.
5) Union Observers Mgmt we will escalate to the Transition Committee.
New Business
1) Weight Limits Union - In Malvern the employees are being ordered to deliver items that exceed the Corporations weight limits of 30 kilos. Mgmt will review with the Zone Manager and Superintendent
2) Insurance Requirements Union concern that some employees are being advised that they no longer need commercial insurance, this is coming from Ottawa. Mgmt there may be some confusion in the definition of commercial insurance. We will follow up with the Transition Committee for coverage required for compliance to the Art. 32.02.
3) Communication re Easter Holiday Union advised that the communication sent to the RSMCs with respect to the Easter holiday was incorrect. Mgmt yes, this communication is being reissued.
