Re: YDC Monthly Meeting Held on October 21, 2009

Attendees;

For the Corporation                                 For the Union

Kimti Aggarwal                                      Mike Duquette

                            Warren Lee                                             Learie Charles

                                                                                            Ellen Deschene

                                                                                            Ken Davidson

Security

Management presented CUPW a package of documents for the Union to review.  Currently, there are no updates on changing locks and swipes on the buildings.

Equal Opp. List

The Union raised concerns that the updated lists are not posted.

Management will ensure statutory holiday equal opportunity lists will be posted for November 11, 2009.

The Union stated that all equal opportunity lists are to be posted. This includes lists for loop, flex part time and etc.

Management advised the Union that these lists are posted behind glass cases.

The Union advised management that lists are still need to mark off even if it is blanket over time is offered.

Management stated a sign up sheet is used when blanket over time is offered.

The Union stated there is no method of assigning emergency over time and wishes to review lists that are currently used.

Management agreed to follow up with that.

Flex Drivers

Management advised the Union that more details will be discussed at the restructure meeting.

The Union stated that there are still issues with the flex driver. Other regions in the country such Hamilton Local have a locally agreed formula to address these issues.

The issue is where a flex driver is assigned to a loop in a geographical area. Sometimes a flex is required to drive outside his assigned geographical area which requires more driving time as compare to the predetermined value assigned within his area. For example when a time value assigned to one point of call to another is 2 minutes within the loop in his geographical area, the issue arises when the flex is required to drive outside his geographical area and the driving distance is much greater than the distance within the loop, the time value assigned is still 2 minutes. It is not adjusted to compensate the greater distance.

Safety Shoes

David Roberts completed an audit on safety shoes. Safety shoes are issued to employees who are MMHE operators and claps monos.

The Union stated that the Low Dock area has always been a safety area and that safety shoes are required in areas where monos are been moved.

Management advised the Union that Low Dock area is not a safety shoes requirement area. Employees who are using pump trucks to move monos do not need safety shoes.

Management indicated that the six docks, high docks, building of monos and operating MMHE required safety shoes.

The Union questioned whether safety shoes are required to walk through or across MMHE area.

The Union asserted safety shoes are part of the uniform entitlements and some employees were sent home without proper uniform.

A/L Coverage/Selection by Relief MSC

As of date, Union still receives complaints and issues regarding this matter. According to management, these issues have been addressed since last month’s U/M meeting.

The Union is requesting that management to send them a copy of bid/posting currently used.

HRDC Yearly Report

Management provided draft copy of HRSDC report to union and they questioned about the days lost due to the injuries. Management confirmed that these are the number of injuries, not the lost time. This report is to be completed by LJOSH on a monthly basis.

Policy on Pay Issues

Lance Waine, Labour Relations has sent a reply from CPC National to the Union in the week of Oct.25, 2009.

YDC Restructure

Matters are to be discussed in restructure consultation.

PDT Chargers

Management is still in the process of testing these chargers. Sixteen employees are currently testing them.

Clerk Uniform Entitlements- Parcel Support PO4

The Union stated that some employees are still not getting any entitlements under article 34, Table 2. The issue may be SAP inputs that these Parcel Support PO4s are entered as PO4 clerks, similarly to the clerks in the plant such as SCLPP. PO4 clerks in other plants are different from the ones here at YDC. It is a matter of amending the employee classification in SAP. There may be credits arrear for all those years that employees may be entitled to.

New Issues

The Union raised concerns that management disregards all agreements and the Collective Agreement. It appears that there is no effect on whatever agreements and resolutions the Parties have reached. Any issues that the Corporation agreed to look into it, is of no assistance either because these issues still surface later.

YDC Bar Chart

Bar Charts as of October 5, 2009 will be sent to the Union. There are numerous people on TSOS.

The Union stated that there are 118 full time routes and YDC has more employees off work than other area. The information on the Bar Chart does not match.

Round Table

The atmosphere on shift # 1 is bad. Supervisors were not allowing employees to go the washroom. Supervisors were checking their stations, conducting observations and monitoring employees’ performance, interviewing employee for not performing up to speed and mechanics were not allowed to speak to PO4s.

Other issues include that management informed employee can only bid 1 month at a time for when the Parties agreed 3 months at a time for TN and backfill issues surface. Management requested the specific details to above issues and will respond to the information as it becomes available.

Next meeting is on November 18, 2009 at 9 am at YDC.

Meeting is adjourned.
