CUPW: Memorandum of Agreement
was signed stating that the employee was to pay back pension amounts which
he did and now CPC is also taking pension arrears off of his cheque.

CPC – A floor study is being
conducted and in the meantime the Corporation’s Network function is sending
two trucks until it’s been determined whether nor not a lift can be
installed so that mono’s can be double stacked.
CUPW - asking for the names
of committee members to
sit together on a regional
level as per point 8.

CUPW – Union agrees to the
change of the 6.05 notice
implementation date of
October 17 from September 19
and doesn’t need CPC to issue
anew 6.05 notice.

CUPW – 6.05 lists just
received are inaccurate and need to be reviewed
CPC- Requests the Union to identify inaccuracies.
- MMHE instruction.
CUPW - gave a presentation on
the MMHE training and instruction
and the impacts of this type
of work and training within the work environment. Requests the Corporation
to standardize trainers, evaluations of trainers/operators, type of training
etc to benefit the work environment and reduce safety concerns that have the
potential to result in injuries. Request further meetings with the
Corporation’s representative in order to establish consistency across the
region. Current operators need to be reassessed/trained. Any operators that
are operating without training evaluation etc are to cease operating
immediately.
CPC- will review and advise.
- 17.04 process. Log Sheets.
CUPW – Informed the
Corporation the Union does not agree with Log sheets used as the tool to
solicit employees who have elected to work overtime in their depot. It is
the position of the Union the Corporation is required to ask every employee
on each occasion overtime is offered.
CPC – Such sheets have been
used previously in this area and the Corporation views the sheets consistent
with the collective agreement.
CUPW – Placed the Corporation
on notice that in the event the log sheets are utilized, grievances will be
submitted.
CPC – Reiterated, some sites
have been using it for years and understands
that the issue has been
grieved by Regional CUPW in British Columbia
scheduled for expedited
arbitration in the near future. In the meantime the Corporation is inviting
local consultation.
CUPW – will be filing
grievances as they become aware of the Log sheets being put into use
reiterating the Locals cannot agree to the log sheets.
- Regional Pubs and Ads Processing Kitchener
CUPW –Informed, the Union has
not had had enough time to digest the package from CPC. However believe
this project falls within Article 29 since the Corporation is changing the
manner in which this product is processed. In addition, the Union sees an
increase in work in the London, Hamilton and Windsor plants but a decrease
in the Kitchener plant.
CPC – The Corporation has
taken the position that this change in processing is not technological
change as defined in article 29.
CUPW – Reminded CPC of the
continuous flow arbitration, which determined similar changes did invoke
Article 29. The Union informed the Corporation the reason for the 120 day
period is to allow the Union an opportunity to assess the impact of such
changes. To this extent the Union wishes time to review the impact however
does not oppose continued discussions on the matter with the Corporation.
CPC – Will review and
respond. The Corporation informed the Union the changes are to address our
customer’s immediate needs, not to pursue immediate costs savings. The
Corporation informed the Union the Corporation would invite ongoing
discussions.
CUPW- Recognizes this isn’t
about cost and is about improving service.
The Parties agreed to
continue discussion immediately recognizing the immediate service needs of
the customer.
Subsequent to the consultation, the Union and
Corporation have signed a Memorandum of Agreement regarding this change in
process and commitments made by both the Corporation and the Union.

1.
Brantford/Simcoe.
CUPW –The Local Area Manager
requested a meeting with the CUPW Local when grievances were filed
respecting an RSMC represented employee driving on the wrong side of the
road. It had been reported to the Union that the manager informed the
employee that continued conduct may result in the termination of the RSMC’s
employment. Regional CUPW have not received a response
from Local management to their
written request to consult on the matter. Further, Regional CUPW views the
policy as unilateral in nature and a subject that the parties are required
to consult prior to implementation.
CPC – Informed the Union the
expectation is a National expectation and conforms to the Highway Traffic
Act. All RSMC represented employees were notified of expectations regarding
adherence to the traffic laws. The Corporation is not in a position to amend
or alter this direction and expectation but is available for consultation.
2.
Driving on wrong side of road.

of delivery procedures
CPC-The Corporation will
adhere to the National direction
previously provided to the
RSMC employees.
Copy of expectations will be
provided to the Union.
Subsequent to the consultation, the Union was
provided with the delivery expectations of all RSMC represented employees.

CUPW: presented list of
representatives who should be informed
of safety matters.
CPC- Offices with 20
employees or less are governed by the Labour Code. Subsequent to the
consultation the Corporation advises that the issue raised by the Union will
be addressed through the grievance filed by the Union’s National office.

RSMC Route revisions, restructures, staffing and hiring.

Listowel RSMC Route # 3.
CUPW –Route is vacant and
Management representatives are performing the sort and delivery duties.
CPC – The Corporation confirms
that the Supervisor has been advised to stop performing these duties. A
competition is underway to staff the route. There is a potential employee
who may take the route but is not willing to use his or her own vehicle, as
it is too expensive. As of today a vehicle has been rented and the
supervisor is no longer performing these duties. The route will be
reviewed. Once a new employee is hired we are going to provide some
training and assistance for the first month.
CUPW – Believes that the
Corporation has miss-treated the former employee. If the assistance offered
today had been available to the previous route holder, that employee would
still be performing the route. The Union asked if the Corporation would be
willing to bring her back and provide her the assistance that you are now
willing to provide?
CPC – will see where we are in
the current staffing process and will review prior to making any final
decision prior to advising the union of our position.
7.
St. Catharine’s Group 2 Temporary employees ordered to perform
duties on SS 4&5 route.
CUPW –Informed the Corporation
there is no contractual provision in place which would allow the Corporation
to ask or direct a blue book relief employee to perform work on an RSMC
route and to do so is a violation of the (blue book) collective agreement.
In addition,
the Union has directed members
to refuse requests or direction from the Corporation to assist on RSMC
routes. St. Catherines Management have requested or directed indeterminate
or temporary employees acting in a relief assignment to assist on an RSMC
route. The Union reiterated, that provided the request of a temporary
employee did not impede or effect their assignments under the (blue book)
collective agreement or those temporary employees who are not on an
assignment, an offer of work on an RSMC route would not be viewed as a
violation. As an example, a temporary employee can be offered work on an
RSMC route upon completion of his/her duties on an assignment obtained under
the blue book collective agreement.
CPC –Local management is
reviewing the situation and will look into alternatives to resolve the
issue. The Corporation will advise the Union.
8.
Guelph. Civic addressing.
CUPW - What is the process for
civic addresses?
CPC – If the RSMC where the
customer resides then they are expected to deliver the mail even if the mail
does not have a civic address. RR#2 Puslinch has been resolved.
9.
London. Lock changes on Relay Boxes.
CUPW- Is of the position that
RSMC’s are only required to change the locks on points of call within their
route and not on other routes.
CPC- The Corporation will
clarify the specifics
within Depot #1 in London.
Subsequent to consultation…London depot #1 has instructed RSMC route
holders that they are only responsible for lock changes on their own route.
