LIEU DAYS AND DEC 24 & 31 2007
The employer has recently denied LIEU DAY requests for December 24, 2007 and December 31, 2007 in some locations, contrary to the Collective Agreement.
Employees wishing to take off December 24, 2007 and/or December 31, 2007 who have “Comp Time” or Annual Leave may apply for those days, but it is subject to operational requirements.
On the other hand, employees who have Lieu Days as defined in Article 18.02(a)&(b), are entitled to take the days off as long as they provided ten (10) working days notice in writing. It is not subject to operational requirements and it is not an “obey now and grieve latter” situation.
The employer may restrict the number of FT Letter Carriers on Lieu Day Leave between December 15 and January 15, if they consult with the Local in October. As per Appendix “Y” the employer must determine the amount of pre booked leave in each location, inform the employees there is a restriction and allow employees to submit applications prior to November 1. The employer has never consulted on this provision or indicated they had a problem based on historical data. Even if they had, they still have to allow 25% of the FT Letter Carriers in every station to be off.
This restriction ONLY applies to FT Letter Carriers; it does not apply to Mail Service Couriers, Clerks or Mechanics.
