MEMORANDUM OF AGREEMENT

 

BETWEEN

 

CANADA POST CORPORATION (The Corporation)

 

AND

 

CANADIAN UNION OF POSTAL WORKERS (The Union)

 

 

IN THE MATTER OF A RESTRUCTURE IN DON MILLS

 

The Parties agree that the scheduled implementation of the restructure will proceed as of September 18, 2006.

 

Bidding of routes will occur in the normal course, details identified in the consultation minutes of September 6, 2006.

 

Each Party will identify one resource which will work exclusively addressing and reviewing all data relating to this restructure as of September 18, 2006 @ the Don Mills postal unit. Bill Weir will be the union designate.

 

At the conclusion of this review the Parties will consult with respect to these findings. At that point the parties will decide as to the course of action to implement, the union reserving its rights to request a full bidding exercise be conducted under article 47. Any displaced employee as of September 18, 2006 will be considered as having bidding rights in the Don Mills postal unit, (March 20, 2006).     

 

If any route becomes over assessed as a result of this review, excluding new points of call added, over assessment pay in accordance with Appendix V of the collective agreement will be applicable from September 18, 2006. Values relating to any new points of call will only be included in the assessed value of the route.

 

If any issues remain unresolved after this review and consultation, the union retains its rights to the grievance procedure, having twenty-five (25) working days following consultation to submit a grievance to the grievance procedure.

 

The Parties agree to include the three (3) MLC routes in postal unit O in this MOA.

 

The above resolves all outstanding issues at this point.
